Terms of Service

By engaging in any services provided by Aptura Photography, LLC (“Aptura Photography“, “Aptura,” “we,” “our,” or “us”), including but not limited to photography consulting, trip planning assistance, educational content, training sessions, photography tours, workshops, coaching, or equipment rentals (collectively, the “Services”), the client (“Client,” “you,” or “your”) agrees to the following Terms and Conditions.
1. Nature of Services
Aptura Photography, LLC offers advisory and educational services designed to help clients improve their photography skills and optimize their travel experiences. Our offerings may include:
Personalized trip and logistics consulting
Photography training and coaching
Workshops and field-based instruction
Online or in-person educational materials
Group or private photography tours
Rental of photography equipment owned by Aptura
All advice and guidance are provided in good faith, based on professional experience, and are intended for general informational and educational purposes only.
2. Client Responsibility
It is the Client’s responsibility to:
Verify all travel logistics independently (e.g., flights, visas, vaccinations, insurance, health and safety requirements)
Evaluate and confirm the suitability of any locations, accommodations, or operators recommended
Use judgment in applying any photography techniques or advice received
Ensure they are medically and physically fit to participate in any photography or travel-related activities
Aptura Photography, LLC does not act as a travel agent, medical advisor, or legal consultant. All decisions related to travel, safety, health, and photography practices remain the sole responsibility of the Client.
3. Assumption of Risk
Participation in photography training, workshops, tours, or any other field-based activities involves inherent risks, including but not limited to:
Outdoor hazards (weather, terrain, wildlife, etc.)
Travel-related risks (transportation delays, accidents, illness)
Equipment usage and handling risks
By participating in any Services, the Client acknowledges and assumes all risks associated with these activities.
4. Release of Liability and Indemnification
To the fullest extent permitted by law, the Client agrees to release, waive, discharge, and hold harmless Aptura Photography, LLC, its owners, employees, contractors, instructors, affiliates, partners, and agents (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to:
Injuries (including death), accidents, or illnesses occurring during any training session, workshop, tour, or activity
Loss or damage to personal property, including camera gear or other equipment
Financial losses or dissatisfaction related to travel arrangements, recommendations, or bookings
Any direct or indirect consequences of applying the educational or consultative guidance provided
The Client further agrees to indemnify and hold harmless the Released Parties from and against any liabilities, costs, or legal claims arising from the Client’s participation in or reliance on any of Aptura’s Services.
5. Limitation of Liability
In no event shall Aptura Photography, LLC be liable to the Client for any indirect, incidental, special, consequential, or punitive damages arising from the use of Services, even if we were advised of the possibility of such damages. Our total liability under any circumstances shall be limited to the amount paid by the Client for the applicable Services.
6. No Guarantee of Outcomes
While our goal is to enhance your photography and travel experience, we make no guarantees regarding specific outcomes, photographic results, or client satisfaction. Success depends on many external factors beyond our control, including environmental conditions, individual effort, and third-party services.
7. Intellectual Property
All materials, guides, images, training documents, and proprietary content provided as part of the Services are the intellectual property of Aptura Photography, LLC unless otherwise specified. These materials may not be copied, reproduced, redistributed, or used for commercial purposes without express written consent.
8. Rental Equipment Terms
Aptura Photography, LLC may offer select photography equipment for rent to clients. By renting any equipment through our platform, you agree to the following terms:
All rented equipment is the property of Aptura Photography, LLC and is insured under our business insurance policy.
If rented equipment is lost, stolen, or damaged while in your possession, you are responsible for paying either:
A deductible of $500, or
The actual replacement cost of the item(s),
Whichever amount is less.
This deductible reflects the amount we must pay to our insurer in the event of a claim.
For certain rentals (at our discretion), the $500 deductible may be pre-authorized or charged at checkout and held as a deposit. This amount will be fully refunded once the equipment is returned in acceptable condition.
You are expected to return all gear in the same condition in which it was received, by the agreed-upon date.
Failure to return items on time, or in proper condition, may result in additional charges.
Rentals are subject to availability and approval, and may be declined at our sole discretion.
By completing the rental checkout process, you affirm that you understand and agree to these terms.
9. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in St. Louis County, Missouri.
10. Modification and Acceptance
Aptura Photography, LLC reserves the right to modify these Terms & Conditions at any time without notice. By continuing to use our Services after changes are posted, you agree to be bound by the updated Terms.
By scheduling, purchasing, or participating in any Service provided by Aptura Photography, LLC, the Client confirms that they have read, understood, and agreed to these Terms & Conditions.
